Canvas Collective – Terms & Conditions
Effective Date: 12 January 2025
These Terms & Conditions (“Terms”) govern your use of Canvas Collective’s art leasing services. By entering into a lease agreement with us, you agree to these Terms.
1. Services
We provide art leasing services for businesses and individuals.
We may also offer artworks for sale in the future.
2. Lease Terms
Minimum lease period: 1 year.
Lease begins on the date of delivery and ends on the agreed return date.
All artworks remain subject to these Terms throughout the lease period.
3. Payment
Payment must be made upfront in full at the start of the lease.
Prices include GST (if applicable).
Leases are not valid until payment has been received in full.
4. Delivery, Installation & Return
Delivery, installation, and return are included if the delivery location is within the Illawarra, South Coast, or Sydney (restricted postcodes).
Additional costs apply for locations outside these areas and will be agreed before delivery.
Clients must ensure safe and accessible conditions for installation and removal of artworks.
5. Ownership of Artworks
All artworks remain the sole property of Canvas Collective during the lease period.
At the end of the lease, you may have the option to purchase the artwork under a separate agreement.
6. Handling & Storage of Artworks
You agree to handle and store all leased artworks with care and in accordance with the following requirements:
Artworks must be kept indoors at all times.
Artworks must not be exposed to direct sunlight, high humidity, smoke, extreme heat, or water sources.
Artworks must not be stored in garages, basements, outdoor structures, or any location that is not climate-stable.
Artworks must not be placed above fireplaces, heaters, or in areas of high traffic where accidental damage is more likely.
Artworks must not be reframed, altered, or repaired without written permission from Canvas Collective.
You must follow any additional written care instructions provided by Canvas Collective or by the artist.
7. Insurance & Liability
Canvas Collective insures artworks during the lease period unless otherwise agreed in writing.
Insurance coverage may be voided if you fail to comply with the handling and storage requirements in Clause 6.
If an insurance claim is refused due to improper care, alteration, or misuse, you are financially responsible for the loss.
Compensation may be required up to a maximum of:
AUD $3,000 for artworks up to 0.7m x 0.5m in size, or
AUD $10,000 for artworks up to 1.5m x 1.1m in size.
For artworks larger than 1.5m x 1.1m Canvas Collective may request a higher amount to recover the costs.
8. Damage & Misuse of Artworks
You must not misuse any leased artwork. Misuse includes, but is not limited to:
Altering, defacing, reframing, or repairing the artwork without written consent.
Displaying the artwork in any location that may damage its reputation or the reputation of the artist or Canvas Collective.
Using the artwork for advertising, promotional, or commercial purposes without written permission.
Lending, subleasing, or otherwise transferring possession of the artwork to a third party.
If misuse occurs, Canvas Collective reserves the right to:
Terminate the lease immediately;
Recover costs under Clause 7; and/or
Refuse future service to the client.
9. Refunds & Cancellations
You may cancel a lease early, but no refunds are provided for unused lease periods.
Refunds are only available in the event that:
An artwork is delivered damaged; or
The wrong artwork is delivered.
In these cases, you must notify Canvas Collective immediately on delivery.
Each claim will be assessed individually, and Canvas Collective may, at its discretion, offer a refund, replacement, or repair.
No refunds are available for change of mind once the lease has commenced.
No cooling-off period applies.
10. Termination
Canvas Collective may terminate the lease if you breach these Terms.
Upon termination, you must immediately return the artwork at your own cost (unless otherwise agreed).
11. Liability
To the fullest extent permitted by law, Canvas Collective is not liable for indirect, incidental, or consequential losses.
Our total liability for any claim is limited to the total amount paid under the lease agreement.
Nothing in these Terms excludes your rights under the Australian Consumer Law.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the jurisdiction of the courts of New South Wales.
